1. INTRODUCTION
This End User License Agreement ("Agreement") constitutes a legally binding contract between you ("User" or "you") and DIVINE Screener ("DIVINE," "we," "us," or "our"), governing your access to and use of our crypto trading signal services, including all DIVINE Telegram channels, software interfaces, signals, alerts, reports, and related documentation (collectively, the "Service").
By accessing or using any aspect of the Service, you expressly acknowledge that you have read, understood, and agree to be bound by all terms and conditions contained in this Agreement. If you disagree with any part of these terms, you must immediately discontinue use of the Service and all associated platforms.
2. CRYPTO-SPECIFIC ACKNOWLEDGMENTS
By using the Service, you expressly acknowledge, understand, and agree that:
Cryptocurrency Market Volatility: Digital asset markets experience extreme price volatility, with potential for rapid and significant value fluctuations that may exceed those in traditional financial markets
Blockchain Immutability: All blockchain transactions are permanently recorded and irreversible; DIVINE has no capability to recover, reverse, or restore lost or stolen cryptocurrency assets
Regulatory Uncertainty: The legal and regulatory landscape for cryptocurrencies varies greatly across jurisdictions, remains in flux, and may change rapidly without notice
Network Constraints: Blockchain network conditions, including congestion, gas fees, finality times, and technical limitations on various protocols, may materially affect trading opportunities identified in our signals
Security Responsibility: Management of all security risks inherent to cryptocurrency participation—including smart contract vulnerabilities, protocol exploits, private key management, and wallet security—remains solely your responsibility
Tax Compliance: Tax consequences of cryptocurrency trading differ by jurisdiction and personal circumstances; compliance with applicable tax reporting and payment obligations is exclusively your responsibility
3. LICENSING AND USAGE RIGHTS
DIVINE grants you a limited, non-exclusive, personal, non-sublicensable, and non-transferable license to access and use the Service, subject to the following crypto-specific restrictions and conditions:

Public Signals: May be shared, forwarded, or discussed in public forums, but not commercialized or resold
Premium Signals: Licensed exclusively for your personal use; sharing, redistributing, or providing access to others is strictly prohibited
Blockchain Interaction: Nothing in this Agreement restricts your ability to independently interact with public blockchains or execute transactions based on signal information
Content Citation: You may reference, cite, or attribute DIVINE signals in public discussions with proper attribution
3.2 Prohibited Activities
You expressly agree NOT to engage in:
Signal Arbitrage: Reselling, repackaging, or monetizing DIVINE signals through other channels, platforms, or services
Unauthorized Automation: Creating or deploying automated trading systems that execute based on DIVINE signals without express written permission
Blockchain Network Abuse: Executing excessive transactions intended to manipulate signal detection algorithms or blockchain activity metrics
MEV Exploitation: Using DIVINE signals for sandwich attacks, frontrunning, backrunning, or other Maximum Extractable Value extraction techniques targeting other users
Brand Impersonation: Creating tokens, NFTs, smart contracts, or other blockchain assets that impersonate or suggest affiliation with DIVINE
Market Manipulation: Using signals to coordinate pumps, dumps, wash trading, spoofing, or other market manipulation schemes
Community Disruption: Engaging in toxic, harmful, or disruptive behavior in DIVINE community channels
Violation of these restrictions may result in immediate termination of your access without refund, potential legal action, and where applicable, reporting to relevant authorities.
4. SUBSCRIPTION TERMS FOR PREMIUM ACCESS
4.1 Subscription Models
DIVINE Public: Free tier access with 6-minute delayed signals and limited feature set
DIVINE Premium: Paid subscription (2,500 Stars⭐️/month) providing instant signals and full feature access
4.2 Payment Options
Fragment.com / Split.tg: Privacy-preserving option, no KYC required, lowest cost (~$37.50/month)
Telegram Desktop: Standard card payment processing with moderate payment processing fees
4.3 Important Payment Terms
Flexible Subscription: Month-to-month subscription model with no long-term commitment
Cancellation Rights: Cancel at any time through your subscription provider
No Refund Policy: All payments are final and non-refundable due to the immediate delivery of digital services
Price Stability Commitment: Current pricing will be maintained for at least 3 months following any announced increase

Predatory trading tactics
Recommendation: Avoid purchasing more than 3.5% of any token's total supply to maintain market integrity and prevent manipulation.
5.2 Community Guidelines
Users shall not:
Coordinate attacks on projects or communities
Impersonate DIVINE or claim affiliation without authorization
Disrupt blockchain networks or protocols
Harass project developers or community members
Misrepresent signals or their performance
5.3 Enforcement Measures
DIVINE may take any of the following actions for violations:
Issue warnings
Temporarily suspend access
Permanently terminate accounts without refund
Report illegal activity to appropriate authorities
Deploy technological measures to prevent abuse
6. RISK DISCLOSURES AND DISCLAIMERS
DIVINE signals involve substantial risk of loss. Past performance does not guarantee future results.
6.1 Signal Accuracy
No Perfect Information: Blockchain data may be incomplete or delayed
Market Conditions: Signals are time-sensitive and market conditions may change rapidly
Technical Limitations: Certain blockchain activities may not be detectable by our systems
Force Majeure: Network congestion, forks, or attacks may render signals unusable
6.2 Investment Risks
Capital Loss: You may lose your entire investment

7. INTELLECTUAL PROPERTY RIGHTS
7.1 DIVINE Ownership
DIVINE owns and retains all rights to:
Signal algorithms and methodologies
Security assessment systems
User interface elements and designs
DIVINE name, logo, and branding
Jesus and Lucifer Mode frameworks
All other proprietary technology and content
7.2 Blockchain Interoperability
This Agreement does not restrict:
Your right to independently interact with public blockchains
Your ownership of tokens purchased based on signals
Your use of public on-chain data
8. LIMITATION OF LIABILITY
To the maximum extent permitted by law, DIVINE and its affiliates shall not be liable for:
Trading Losses: Any financial losses resulting from signals or trading activity
Opportunity Costs: Missed trading opportunities or market movements
Technical Issues: Service interruptions, delays, or technical malfunctions
Blockchain Problems: Network congestion, high fees, failed transactions, or protocol issues
Smart Contract Failures: Exploits, hacks, or vulnerabilities in token contracts
Regulatory Changes: Legal or regulatory developments affecting cryptocurrency markets
The total liability of DIVINE for all claims shall not exceed the amount you have paid in the past six (6) months.
9. DISPUTE RESOLUTION AND GOVERNING LAW
9.1 Informal Resolution
Before pursuing formal legal action, you agree to:
Contact DIVINE support with your concern
Allow 30 days for DIVINE to investigate and respond
Engage in good faith negotiation to resolve the dispute
9.2 Arbitration Agreement
If informal resolution fails, disputes shall be resolved through binding arbitration rather than court proceedings, except for small claims court actions or intellectual property enforcement.
9.3 Class Action Waiver
You waive any right to participate in class actions or consolidated proceedings.
9.4 Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the Cayman Islands, without regard to conflict of law principles.
10. MODIFICATIONS AND TERMINATION
10.1 Agreement Updates
DIVINE may modify this Agreement at any time by posting updates to our documentation or Telegram channels. Your continued use constitutes acceptance of changes.
10.2 Termination Rights
By You: Cancel your subscription at any time
By DIVINE: We may suspend or terminate your access for any violation of this Agreement or at our sole discretion
10.3 Effect of Termination
Upon termination:
Your access to Premium features will cease
No refunds will be issued
Sections on liability, disputes, and intellectual property survive termination
